Alabama, Florida are top 2 in BCS

Alabama and Florida are at the top of the season's first BCS standings, making it yet another all-SEC top two, with Oregon and Kansas State close behind the Gators.

The Crimson Tide in first was no surprise. Alabama is an overwhelming No. 1 in both polls used in the BCS formula. Florida in second was less anticipated. The Gators are No. 3 in the polls, but rated best by the computer rankings That gave them a slight edge over Oregon and Kansas State when the numbers were crunched. Florida's BCS average is .9092. Oregon's is .8993 and Kansas State's is .8963.

Notre Dame is fifth and not too far back at .8774.

Despite the strong showing by the Southeastern Conference, another all-SEC national championship game is still a long shot. Oregon's schedule is backloaded with strong opponents and the Ducks will likely be able to close the gap in the computers if they keep winning.

The Ducks play Arizona State on Thursday (5-1) and still have games against Southern California and Oregon State left, and a possible Pac-12 title game.

Florida has some tough games left, too, starting Saturday against South Carolina.

With half the season still to play, there are plenty possibilities and teams still alive.

Teams with one loss, such as sixth-place LSU, seventh-place South Carolina, ninth-place Oklahoma and 10th-place USC are still very much in the race as long as they keep winning.

Oregon State is in eighth, the lowest rated of the unbeaten teams.

This is safe to say: If Alabama keeps winning, the Tide will play for its second straight national title, and third in four seasons.

Alabama has never before been first in the initial standings. Seven times since the Bowl Championship Series was implemented in 1998, the team that was first in the initial standings went on to play in the BCS title game.

Seven times the team that started second played for the BCS title. And only twice has neither of the teams that were in the top two spots in the first standings reached the title game.

In 2012 there were 362 Huntersville houses sold, the average listing price was 251,589, and the average selling price of $244,671, or $94 per square foot, and the average house spent 99 days on the market.

In the same period in 2011, there were 303 homes sold, with an average list price of $278,473 and sold for $267,812,or $95 per square foot, and that house stayed on the market 124 days in 2011.

This represents good news for Huntersville homeowner across the board: a 19% increase in house sales, no measurable change in square foot prices with sizable gains in the average sales price, and a 29% reduction in days on market.

There are 201 homes for sale today in Huntersville, representing a low 3-4 month supply of homes, almost a balance market between home sellers and buyers.

Suspect charged in death of missing UNH student

DOVER, N.H. (AP) ? An actor and martial arts instructor was charged in the death of a 19-year-old University of New Hampshire student who disappeared last week, and the girl's family pleaded for her to be brought home.

Law enforcement officials believe Elizabeth "Lizzi" Marriott, a marine biology major who volunteered at the New England Aquarium, is dead. The search for her body was continuing, Assistant Attorney General James Vara said Saturday.

Seth Mazzaglia, 29, of Dover, was charged with second-degree murder.

"This is the worst parents' nightmare, a missing child and with an unfavorable outcome," Marriott's family said in a statement Saturday. The family asked for prayers for rescue personnel who are looking for their daughter, saying they need to "bring her home."

At a vigil for Marriott in her hometown of Westborough, Mass., on Saturday night, her father, Robert, choked back tears while speaking to the hundreds who had gathered.

"Together we created an angel," he said, "and tonight she is home in heaven."

Vara said Mazzaglia knew Marriott, but declined to say how or what led to his arrest. He said police had credible information leading them to believe Marriott is dead, though he wouldn't elaborate. Mazzaglia was scheduled to be arraigned Monday.

A family friend, Dawn Downey of Westborough, Mass., described Marriott as an attractive young woman who was active in chorus in high school and was prom queen during her junior year. Marriott was helping to put herself through college by working at Target.

"She was just a good girl. That's probably what got her in trouble. She was too trusting and she was beautiful. Those two things will kill you," Downey said.

Marriott had attended a class Tuesday night and made plans to visit friends in Dover. Her cellphone was last used in Dover that night, according to fliers that family members posted around town. Her car was later found in a parking lot on campus in Durham.

"We were greatly saddened to learn of Lizzi's death and we extend our deepest sympathies to her family and friends," UNH President Mark W. Huddleston said in a statement. "Lizzi was a new member of the university community and will be missed in our classrooms. Our focus now will be on supporting our campus community during this difficult time."

The university was making counselors available to students. A moment of silence was observed in Marriott's honor at the school's hockey game Saturday night.

Marriott was a 2011 graduate of Westborough High School in Massachusetts. She lived with an aunt in Chester and commuted to the Durham campus. A message seeking comment was left with her parents.

Downey's daughter Nicole, who was Marriott's best friend, described Marriott as a "fun-loving and goofy" young woman who got along easily with others and had a wide circle of friends. She also was a good student who loved animals and science and volunteered at the New England Aquarium in Boston, Nicole Downey said.

"It was a shock to me when I found out she was missing. That was not like her at all," she said. "She was just all around a great person. I don't know why anyone would want to hurt her."

Mazzaglia, who graduated from the University of New Hampshire in 2006 with a bachelor's degree in theater, was active in the arts, performing in several dozen plays and musicals over the last decade in southern New Hampshire.

He also was a martial arts instructor who described himself on websites as having a black belt in karate and being familiar with several forms of martial arts and weapons. And he listed other interests including juggling.

Robert Modee, a friend of Mazzaglia's and a martial arts instructor in Kittery, Maine, said he was struggling to comprehend how Mazzaglia could be charged with murder.

"I don't understand what's going on right now," he told the Foster's Daily Democrat in Dover, N.H. "I'm completely floored with all this."

Mazzaglia was in custody Saturday and could not be reached. It was unclear whether he had a lawyer.

(AP) ? In thousands of Earth orbits, the space shuttle Endeavour traveled 123 million miles. But the last few miles of its final journey are proving hard to get through.

Endeavour's 12-mile crawl across Los Angeles to the California Science Museum hit repeated delays Saturday and Sunday, leaving expectant crowds along city streets and at the destination slowly dwindling.

Officials estimated the shuttle, originally expected to finish the trip early Saturday evening, would not arrive at the museum until early Sunday afternoon.

At times it has seemed the only thing moving was the shuttle's fast-changing ETA.

Saturday started off promising, with Endeavour 90 minutes ahead of schedule. But accumulated hurdles and hiccups caused it to run hours behind at day's end. The problems included longer than expected maintenance of the rig carrying the shuttle and physical obstacles within the shuttle's wingspan including light posts, building edges, and most of all trees.

In a scene that repeated itself many times, a small tree on the narrowest section of the move brought the procession to a stop, forcing crews to find creative ways to dip a wing under or raise it over the tree without having to cut it down.

Some 400 trees had been removed to avoid such situations, but officials said most of the trees that gave them trouble could not be cut down because they were old or treasured for other reasons, including some planted in honor of Martin Luther King Jr.

The crowd had its problems too. Despite temperatures in the mid-70s, several dozen people were treated for heat-related injuries after a long day in the sun, according to fire officials.

But it was a happy, peaceful crowd, with firefighters having only to respond to a sheared hydrant and a small rubbish fire, and no reports of any arrests.

And despite the late problems the mood for most of the day was festive.

At every turn of Endeavour's stop-and-go commute through urban streets, a constellation of spectators trailed along as the space shuttle ploddingly nosed past stores, schools, churches and front yards as it inched through working-class streets of southern Los Angeles.

Along the 12-mile course, thousands marveled at the engineering. Some rooted for Endeavour when it appeared it might clip a light post.

"This is great for the city as a whole. It makes us proud," said Dean Martinez, a project director for a nonprofit who began waiting before dawn to get a glimpse of Endeavour.

Unlike other high-profile events like the Academy Awards or the Rose Parade, the procession was centered in some of the area's most economically downtrodden and troubled places. The shuttle passed several gritty areas and shuttered businesses, and rolled down many streets that were aflame two decades earlier during the 1992 riots brought on by the verdict in the Rodney King case.

"Having a shuttle come through this area of high poverty, it can only be a good thing" for the community," said Damian Pipkins, a volunteer at Eso Won Books.

Endeavour hit the pavement before dawn Friday, trundling out of the Los Angeles International Airport on a remote-controlled 160-wheel carrier past diamond-shaped "Shuttle Xing" signs. When it reached a freeway overpass that night, it was towed by a truck.

The shuttle made a late-morning pit stop Saturday at the Forum ? former home of the Los Angeles Lakers ? where it was greeted in the arena's parking lot by a throng of cheering spectators. It was late to its second public celebration that included a dance performance choreographed by Debbie Allen.

As it wound through South Los Angeles, residents welcomed its presence. Before the move, some lamented over the loss of shade as trees were chopped down.

Others thought it was a decent trade.

"If you have to go through a little bit of pain to have something nice for the community, then it's worth it," said Pamela Tucker, who lives a block away from Crenshaw Boulevard in Los Angeles.

Endeavour may have circled the globe nearly 4,700 times, but its roots are grounded in California. Its main engines were fabricated in the San Fernando Valley. The heat tiles were invented in Silicon Valley. Its "fly-by-wire" technology was developed in the Los Angeles suburb of Downey.

It's no longer shiny and sleek, like when it first rolled off the assembly line in the Mojave Desert in 1991 to replace the lost Challenger. As it cruised block-by-block, it's hard to miss what 123 million miles in space and two dozen re-entries can do to the exterior.

Shuffling Endeavour through city streets was a laborious undertaking ? nearly a year in the making. It could not be taken apart without damaging the delicate tiles. Airlifting it was out of the question. So was driving on freeways since it was too massive to fit through underpasses.

There were consequences. Several hundred Inglewood residents suffered hours-long outages when power lines were temporarily snipped. Some businesses lost customers because of street and sidewalk closures.

Such a move is not cheap. The cross-town transport was estimated at $10 million, to be paid for by the science center and private donations.

Engineers push FTSE 100 down on earnings concerns

LONDON (Reuters) -FTSE 100 eased on Friday, with a second profit warning in a week from the engineering sector underscoring concerns about the health of third quarter earnings in the face of slowing global and domestic demand.

Mid-cap Morgan Crucible fuelled concerns about slowing growth in China, blaming that and weak demand in Europe as it said full-year results could be significantly below its expectations and unveiled plans to cut jobs.

The profit warning, hot on the heels of one on Monday from fellow industrial materials maker Cookson Group, pushed other engineering companies to the top of the FTSE 100 fallers list. GKN, IMI and Melrose each lost 2.3 to 2.9 percent.

The FTSE 100 was down 6.83 points or 0.1 percent at 5,822.92 points by 1028 GMT, taking its losses for the week to 0.8 percent. The mid-cap FTSE 250 fell 0.2 percent, led by an 11 percent drop in Morgan Crucible in heavy volumes, already at nearly three times the 90-day daily average.

"The screen would tell you it's pretty serious. Whilst we had anticipated that trading would be tough in the second half, it's become clear in Europe and also in China that trading has toughened through the third quarter and that is leading to a reassessment of prospects for the full year," said Dominic Convey, analyst at Peel Hunt.

Convey is reviewing his forecasts for the sector.

"Morgan is getting particularly hit today because it finds itself in the spotlight, but the sector is trading down in sympathy, people are re-rating the sector."

Chinese data on Friday offered more proof of the slowdown hitting the world's biggest metals consumer, with bank lending missing forecasts in September.

China has been an important growth market for UK companies at a time of spending cuts at home and in Europe. In a fresh blow for UK consumers, Centrica, the owner of Britain's biggest energy supplier British Gas, said it will increase domestic gas and electricity prices by 6 percent next month.

Shares in Centrica fell 0.7 percent.

The tough market conditions - with third quarter earnings among Britain's large and mid-cap companies seen down on average 7.4 percent year-on-year, according to Thomson Reuters Starmine - has increased the value of stock picking.

On Friday Hargreaves Lansdown stood out. The investment manager topped the FTSE 100 gainers with a 4 percent share price rise after reporting record high assets and rising revenues.

The firm is in a good position to benefit from a planned overhaul of how consumers are sold investment products from January.

"HL reports an excellent start to October," said Simon Willis, analyst at Daniel Stewart.

"It is well placed ahead of the Retail Distribution Review (RDR), with a competitive fee structure that is ready to go."

I hate the phone because I was a platoon radio operator during the battle of Fallujah, when I was nineteen, and every time somebody called me out there it was a serious fucking emergency.

I had to monitor the net (field communication network) for unit reports on friendly movement so that my platoon did not walk into another?s gun fire.

One time I had told a tank that it would be clear to fire on a building, shortly after I watched a dozen Marines from another platoon take cover behind the same building, out of sight of the tank. The tank?s turret shifted and pointed toward the building.

When there are too many people talking on a radio channel, the net gets tied up and I have to wait for a person to stop talking before I can talk to them. I frantically held down the button to my handset repeating over and over, more panicked and more panicked, ?Cease fire, cease fire, cease fire!? When I let go of the button I could hear the tank power down with a sound like a vacuum cleaner and my handset answered back, ?Roger, cease fire.??

Other times I would need the radio to call for a medical evacuation of friends who had been shot or killed or hit by explosives.

Most days my ear was stuck to my handset for eighteen hours and nothing special but during the times that nothing happened a person could not help but to wonder what the next horrible phone call might be.

When I turn my knob to our battalion channel sometimes the breaking news of the day is a friend from another company has just been killed; or I am sleepy on hour seventeen but keep nodding to the sound of empty radio static that makes a noise like television snow while filled with a cold panic that if I go to sleep, my friends would die because of me.

Sometimes my friend Nate Douglass would call my apartment late at night and I would not pick up. I would want to cry for fear, but did not feel well enough to help someone who needed real help. I would take a moment to recover and carry on with the endless web surfing. He just wanted to talk, so did I, but war is a bitch and we both know it.?

One time I picked up the phone for a number I did not recognize and it was Luis Munoz, our old point man.

He had moved back to Mexico after the service and was calling to tell me about the violence he was witnessing, he said it was worse than Fallujah and he had a child to raise. He had been shot through the leg in Fallujah so bad that he was told he would never walk again.

When we reunited Luis was in physical therapy walking with a cane in his early twenties, by the time he was discharged from the Marines as a wounded warrior he was jogging.

Rich Casares had been hit by an enemy hand grenade in Fallujah, which had damaged one of his eyes. The doctors put an air bubble behind it; I had to write him because he was in a Texas Prison, when he wrote me he would ask for a picture of Fallujah that looked really good so he could have it tattooed across his back.

Paul Johnson has a kid and soon will Donald Blais, they live in Connecticut today and during the battle rushed into a burning house to ferry the bodies of their wounded friends, without being ordered to.

One early morning in my dark apartment I picked up the phone for Nate Douglass who had also been hit by an enemy hand grenade.

We had been best friends in Fallujah.

We talked about our struggles coming home and then we talked about the day he'd been hit by the hand grenade. He would reference the morning and I would retort with my perspective of the same thing.

When we got to the operation he would talk about what he saw inside a house while I would tell him what I saw outside of that house. I realized that the story flowed naturally and that if I had the other members of our platoon who were there that day I was sure that they could reconstruct the story with even more depth.

I told Douglass that night that I had an idea for a documentary that would tell a story of real life heroism and struggle that might answer questions for outsiders and those just returning from their story.

Police: Search continues for missing Colorado girl

WESTMINSTER, Colo. (AP) ? The multi-agency search for a 10-year-old Colorado girl continued in Denver's suburbs Thursday, nearly a week after she disappeared on what should have been a short walk to school.

At a brief news conference, Westminster police refused to suggest any connection between a body discovered late Wednesday in a grassy park seven miles from where Jessica Ridgeway disappeared Oct. 5 ? or even to say whether it was the body of a child.

The search for Jessica continues, spokesman Trevor Materasso said.

He also said authorities were processing evidence from the park and that no additional information was available. He left without answering questions.

Dozens of police officers reported to the Westminster police headquarters before dawn, including officers from Arapahoe and Boulder counties and other agencies.

Jessica's mother last saw her daughter walking to school Oct. 5. Police say the girl is believed to have been abducted and never made it to school, setting off a frantic search by hundreds of law enforcement officials and residents. Her parents were ruled out as suspects Thursday.

Thousands of people have posted photos of the fifth-grader in the neighborhood and online since she vanished on what should have been the short walk to school.

Police initially said the public didn't need to fear a kidnapper ? then said they were investigating whether the case might be related to that of another girl who was abducted for several hours Monday in Wyoming, among other tips they received.

On Wednesday afternoon, authorities changed course more definitively, saying they believe Jessica was kidnapped by an "unknown suspect."

The only real clue police have revealed is the discovery over the weekend of a backpack and water bottle that Jessica had with her when she disappeared. The items were found in the town of Superior, some six miles from her home. Police won't discuss what was found in the bag or testing results on it.

Adding to the mystery was a reported sighting more than 2,000 miles away in Maine of a car with Colorado license plates ? one of hundreds of leads being investigating from at least five states.

Westminster police repeatedly have urged the public to study the details of her face in a photo ? a small, gap-toothed grin, a slight bruise on her nose ? and a short home video, in hopes they may have seen something or come across the girl. They've thanked thousands of Coloradans and others for helping with a search they have insisted is focused on the area surrounding Jessica's home.

Materasso said Wednesday the investigation's focus is not the girl's parents, who are cooperating. Jessica's mother, Sarah Ridgeway, lives Colorado, and her father, Jeremiah Bryant, lives in Missouri.

"We're confident they are not involved in Jessica's disappearance," Materasso said.

Police say they are looking for any possible connection to an abduction and assault of an 11-year-old girl Monday in Cody, Wyo., some 500 miles north.

In that case, a man lured the girl into a sport utility vehicle, saying he needed help finding his puppy. The girl was released four hours later and was discovered by hunters. Police there are looking for a white man, between 55 and 60 years old, with short, strawberry-blond or white hair and a neatly trimmed mustache.

The oldest brain ever found in an arthropod ? a group of invertebrates that includes insects and crustaceans ? is surprisingly complex for its 520-million-year age, researchers report today (Oct. 10).

The fossilized brain, found in an?extinct arthropod?from China, looks very similar to the brains of today's modern insects, said study researcher Nicholas Strausfeld, the director of the Center for Insect Science at the University of Arizona.

"The rest of the animal is incredibly simple, so it's a big surprise to see a brain that is so advanced, as it were, in such a simple animal," Strausfeld told LiveScience.

The discovery suggests that brains evolved a complex organization early on in history, he added.

The evolving insect brain

Arthropods include any animal with an exoskeleton, jointed legs and a segmented body, from lobsters to scorpions to beetles to butterflies. There is controversy about how these various creatures evolved, however. One theory holds that insects evolved from ancestors not unlike today's branchiopods, which are extremely simple?crustaceans?such as fairy shrimp and water fleas. Branchiopods have simpler brains than insects and higher crustaceans, Strausfeld said, so this theory of evolution holds that both higher crustaceans and?insects?evolved very similar complex brains after splitting off from this common branchiopod-like ancestor. Alternatively, all of these groups ? insects, branchiopods and higher crustaceans ? could have evolved from an ancestor with a complex brain, with branchiopods regressing later.

"So the question was, 'What was the early brain, what did it look like? Did it look simple or did it look complex?'" Strausfeld said.

That's not an easy question to answer, given that?brains rarely get fossilized. But Strausfeld's earlier work on arthropod fossils convinced him it could be done. He just had to go to China, home of an amazing collection of stunningly preserved ancient fossils.

Last-minute discovery

In China's Yunnan province, paleontologists have long uncovered fossils from the Cambrian period, which ran from about 542 million to 488 million years ago. These fossils are very well-preserved.

For five days, Strausfeld and his colleagues poured through fossils, searching for dark silhouettes of preserved brains inside ancient arthropod heads. There was one fossil that remained elusive, however: A specimen Strausfeld had read about in a paper by Swedish researchers. They thought they'd seen a fossilized brain.

With only a few hours left in the lab, Strausfeld's colleague, Xiaoya Ma, of the Natural History Museum in London went hunting for the missing specimen. An hour and a half later, she returned with the fossil, an extinct armored creature just a few centimeters long called?Fuxianhuia protensa. [25 Amazing Ancient Beasts]

"I looked at the microscope and I think I said something like, 'Whoopee, I think we've got the crown jewels!'" Strausfeld said. Under magnification, he could see the dark brown silhouette of preserved brain nestled in the arthropod's skull.

"It's pretty bloody marvelous, actually. ? I was sitting looking at the thing, going, 'Oh my goodness gracious,'" Strausfeld said. With only five hours left before he had to leave to give a scheduled talk and fly home, Strausfeld got busy photographing the discovery.

An analysis of the brain revealed it to be in three parts, just as the brains of modern insects are in three parts (known as the protocerebrum, deutocerebrum and tritocerebrum). Nerves from the eyes extend into the protocerebrum, nerves from the antennaes feed into the ancient creature's deutocerebrum, and a third nerve root from further back in the body extends into the tritocerebrum. The researchers report the findings in this week's issue of the journal Nature.

This complex,?insectlike brain?suggests that rather than insects arising from simple branchiopods, today's arthropods descend from a complex-brained ancestor. Branchiopods would later have shed some of this complexity, Strausfeld said, while other crustaceans and insects kept it. In fact, he said, the brain may have evolved to segment into three parts very early on; mammals, including humans, have a?forebrain, midbrain and hindbrain, suggesting a common organization.

"Lots of people don't like that idea, sharing a brain with a beetle, but there's good evidence suggesting that you do," Strausfeld said.

Bug brains may seem simple to us, but arthropods are at the base of many a food chain, making them crucial creatures, Strausfeld said. He and his team plan to return to China to hunt out more ancient arthropod brains.

"What we want to do, of course, is go deeper in time," Strausfeld said.

Fear and voting in America

The biggest motivator in this election isn?t enthusiasm about either of the candidates, Reich writes.?The biggest motivator is fear of the other guy.

What gives? The Pew poll covered the days immediately following last Wednesday?s presidential debate. It didn?t include last weekend. The Gallup poll, by contrast, included the weekend ? after September?s jobs report showed unemployment down to 7.8 percent for the first time in more than three years.

So it?s fair to conclude the bump the President received from the jobs report bump made up for the bump Romney got from the debate. No surprise that voters care more about jobs than they do about debate performance.

But don?t be misled. The race has tightened up.

Moreover, polls of ?likely voters? are notoriously imprecise because they reflect everyone who says they?re likely to vote ? including those who hope to but won?t, as well as those who won?t but don?t want to admit it.?

Remember: The biggest party in America is neither Democrats nor Republicans. It?s the party of non-voters ? a group that outnumbers the other two.?

So the real question is which set of potential supporters is more motivated on Election Day (or via absentee ballot) to bother to vote.

The biggest motivator in this election isn?t enthusiasm about either of the candidates. The Republican base has never particularly liked Romney, and many Democrats have been disappointed in Obama.

The biggest motivator is fear of the other guy.

There?s clear reason for Democrats and Independents to fear Romney and Ryan ? their reverse Robin-Hood budgets that take from the poor and middle class and reward the rich; their determination to do away with Medicare and Medicare, as well as Dodd-Frank constraints on Wall Street, and ObamaCare; their opposition to abortion even after rape or incest, and rejection of equal marriage rights; their support for ?profiling? immigrants; and their disdain of the ?47 percent,? to name a few.

And the thought of the next Supreme Court justices being picked by someone who thinks corporations are people should strike horror in the mind of any thinking American.

Yet Romney is such a chameleon that in last Wednesday?s debate he appeared to disavow everything he?s stood for, hide many of his former positions, and even sound somewhat moderate.

Meanwhile, for four years the GOP and its auxiliaries in Fox News and yell radio have told terrible lies about our president ? charging he wasn?t born in America, he?s a socialist, he doesn?t share American values. They?ve disdained and disrespected President Obama in ways no modern president has had to endure.

They?re drummed up fear in a public battered by an economic crisis Republicans largely created, while hiding George W. Bush so we won?t be reminded. And they?ve channeled that fear toward President Obama and even to the central institutions of our democracy, casting his administration and our government as the enemy.

They?ve apparently convinced almost half of America of their lies ? including many who would suffer most under Romney and Ryan.

Republicans are well practiced in the politics of fear and the logistics the big lie. The challenge for Obama and Biden and for the rest of us over the next four weeks is to counter their fearsome lies with the truth.??

Jerry Sandusky faces sentencing in child sex abuse scandal

(Reuters) - Former Penn State assistant football coach Jerry Sandusky is expected to face life in prison when he is sentenced in coming days for molesting 10 boys over 15 years, a case that shocked college athletics and riveted national attention on the issue of child sexual abuse.

Sandusky, 68, faces up to 373 years in prison for his conviction in June on 45 counts of child sexual abuse, including while he was defensive coordinator for Penn State's powerhouse football team. The sentence is to be handed down on Tuesday at Centre County Court.

Sentencing by Judge John Cleland, known for running a fast-paced court, is expected to go quickly, Karl Rominger, a Sandusky lawyer, told Reuters.

"I don't see that the sentencing will take more than several hours at the most, but it all depends," he said.

Asked later if Sandusky would make a statement at the hearing, Rominger texted: "Unsure but likely." Sandusky did not testify at his trial.

Rominger and fellow defense attorney Joe Amendola have said they plan to appeal. They contend they did not have enough time to prepare for the high-profile case.

Defense attorneys and prosecutors will meet with Cleland on Monday afternoon at the courthouse in Bellefonte, Pennsylvania, to coordinate the hearing.

Daniel Filler, a law professor at Philadelphia's Drexel University, said Cleland likely would focus on two factors in sentencing - the severity of the crimes and Sandusky's background, both good and bad.

Sandusky, who retired as Penn State's defensive coordinator in 1999, was convicted of abusing the boys after meeting them through The Second Mile, a charity he founded for at-risk youth.

"What would normally be a defendant's strongest argument for leniency - a lifetime of good works - may be used to justify a harsh sentence for Sandusky because he betrayed the trust of the kids he served," Filler wrote in an email.

VICTIMS TO SPEAK

The Harrisburg Patriot-News reported last month that two of Sandusky's victims would speak about the impact on the victims.

One is a 28-year-old man, designated as Victim 4 in court documents, who said Sandusky lavished him with gifts and trips to football bowl games while abusing him during the 1990s.

The second is Victim 5, now 23, who Sandusky molested in a Pennsylvania State University shower in 2001, the newspaper said. Attorneys for the men were not immediately available to comment.

Before sentencing, the state's Sexual Offenders Assessment Board will report to Cleland on its evaluation of whether Sandusky is a sexually violent predator. The designation would put him under reporting requirements if he were to be released from prison on probation.

Sandusky's abuse ranged from fondling to anal and oral sex, including the rape of a boy in a football shower in 2001.

Former Athletic Director Tim Curry and former university Vice President Gary Schultz face charges of failing to report suspected abuse and perjury in connection with the 2001 incident. Their trial is scheduled to start on January 7.

The explosive scandal led to the firing of revered head football coach Joe Paterno and university President Graham Spanier. Paterno died in January of lung cancer at age 85.

The National Collegiate Athletic Association slapped Penn State with unprecedented penalties in July. They included $60 million in fines and being stripped of all football victories for the past 14 seasons.

At least three of Sandusky's victims are suing the university. Former assistant coach Mike McQueary, a witness to the 2001 incident who lost his job after he testified about it, also sued Penn State last week for more than $8 million.
